I would have thought you need to see the bird properly and remember it to tick it, not just capture it on film or a sensor. I've ticked birds that I've seen and photographed and then identified from the photo and consider that to be no different to identifying a bird in a field guide, however, I personally wouldn't be content seeing a bird in a photo I'd taken that I'd not noticed in the flesh and claiming it. I think it has to go down as a near miss.
