Yeah, I now understand that.
I faced the same issue with getting access to Marvell Gigabit
ethernet chipsets. You need to sign an NDA just to read the data
sheet. However, in that specific case, the driver source was
available, so the NDA related mainly to 'how to get it on your
board'.
Alas, these are engineering trade-off's that must be made.
So 'disappointed' was with the SD card use, as opposed to TS,
which is doing a nice job.

Thats good to know.
My particular issue with using older kernels is that the driver
model changes. I work on x86, PowerPC, and ARM systems, and
maintaining braincells for multiple processors, and multiple
kernel environments is just too taxing. Hence, I prefer to
'go with the flow' and work with 2.6 kernels.
Thanks for responding to the group to these types of messages.
It definitely puts TS in a good light, and I believe encourages
people to use your boards. Good tech support is high on my
selection criteria for use of a device or product.
