Could be a duplex mismatch?  There is a patch on linux-netdev [1] that
changes ep93xx_eth.c to use phylib and properly tell the MAC about
full duplex.  I see it's not in 2.6.23; don't know about 2.6.24.

Can you give a short recipe / script to duplicate the problem?

You probably want to post this to linux-netdev list.
