The NSW National Parks and Wildlife Act 1974

You could also go to jail for 2 years - even possessing a native bird
feather in NSW could theoretically put you in jail for 6 months
I discovered from reading one of the articles on this sad incident that
DEC is translocating penuins to Manly from Pittwater - presumably Lion
Island in the mouth of Hawkesbury north of Sydney.
There is interesting piece of double-think here as one of the reasons
given for listing as the Manly penguins as a threatened population is
"disjunction from other populations" but a google turned up someone from
DEC saying the translocation is OK because the North Head penguins mix
with other penguins!
I really like having penguins in Sydney Harbour, but shifting them into
the heart of a huge city just doesn't seem sensible either from the
viewpoint of penguin conservation or the welfare of the individuals
involved.
Although as birdwatcher I guess I should be encourage DEC to go further.
Maybe translocating some Rock Warblers into the CBD - plenty of breeding
opportunities or how about Lyrebirds into the Botanic Gardens - imagine
a male displaying on the steps of the Opera House!
