Yes, caution is a well advised.  I remember when living in Colorado (USA), peering with my binoculars through a rather impressive looking fence at a nesting Red-tailed Hawk.  I was immediately swooped on by four soldiers in a rather impressive looking armoured personel vehicle, and carrying rather impressive looking automatic weapons in their rather impressive looking hands.  "What the hell'r yew doin'..." they asked in rather impressive voices.  It turns out that I was peering into the Rocky Mountain Arsenal, a high security military facility.  Getting home the same day took rather a lot of explaining.

Todays Courier Mail article has a humerous side to it, but also shows that we birders need to be a little cautious peering around the suburbs with our bino's! I have on more than one occasion in the past felt a little conspicuous birding on my own in and around built up areas, particularly parks and schools! Sadly our intentions may be misread by a society more than a little jumpy about peoples intentions!
