No, you don't need a kernel module unless you want high speed data 
acquisition; you can get data from userspace.  See:
http://tech.groups.yahoo.com/group/ts-7000/message/7687
which tells where to find Jim Jackson's userspace utilities

Also, search for MAX197 in the group archives, there's a lot of info 
already written.
