Damages don't necessarily have to be to something that was privately owned. The Exxon Valdez case in Alaska was an example of damages against the environment. ________________________________ From: Scot Mcphee Sent: Thu 24/05/2007 7:36 AM To: Birding-Aus Cc: Bill Stent Subject: Killing of rare parrots - charges to be heard inRobinvale maistrates Court (Vic) on May 22 On 24/05/2007, at 6:41 AM, Bill Stent wrote: > In that case there's a good argument for a civil (as against > criminal) case against these two (and the company) to recover those > damages. What damages though? They are wild parrots -- not bred parrots (i.e. property that can be damaged). So a civil claim for damages in this case will be thrown out. I hope the two guys were let off easy because the Victorian DPP intends to get the companies (the real culprits in this case) big time. -- http://modular.autonomous.org/music/ ==============================www.birding-aus.org birding-aus.blogspot.com To unsubscribe from this mailing list, send the message: unsubscribe (in the body of the message, with no Subject line) to: ============================= |
