So, is it an off-leash area, or not???
Either way, the dog-owner may well be morally culpable, but if it is
an off-leash area, then he can't be held to have done anything
illegal simply by having the dog off leash. To attempt any form of
prosecution - even if the owner could be found - is then even less
likely to succeed.
Sadly, either way, I think there is little prospect of any come-
back. I know of an area in southern Tasmania where at least three
people I know of have been bitten by a savage dog, being walked - off-
leash - by its owner, in a "Conservation Area" clearly marked as
being a 'no-dog' zone. When confronted by one victim, she said that
he should have known better, because she walked her dogs there every
day. And when reported to the police, they told victims there was
little they could do (even though we do have laws governing such
situations). If they're not prepared to act when people are
attacked, they're even less likely to act to protect some bird that
people neither know nor care about!

I lived Martin Street on Timbrell Park for a few years and moved
out last year. Its not an off leash area. There is a small bush
conservation area thats not so bad actually for the limitations of
the space - the council gardeners do a reasonable job. I thought I
knew every bird in that park (!) although sadly I never saw a stone
curlew there when out walking. This is a sad incident.
