Russ,

I'm not a lawyer, but if you have a permit to clear habitat (e.g. for
property development or crop production), then under the law this action is
probable deemed "reasonable", "necessary" and "justifiable". Therefore, you
would not be culpable under the NSW Prevention of Cruelty to Animals Act,
1979.

Perhaps there are some lawyers who subscribe to Birding-aus who could
confirm this to be the case or otherwise.

Stephen,
             I'm interested to know what form(s) of evidentiary tests would 
be applied to determine whether a bird had been terrified or infuriated ? 
Could not the same tests be applied to any form of deliberate habitat 
destruction (eg for house building) or disturbance at a wader roost?
