The reports are that the Swamp Harrier is very secretive in its nesting locations. See eg the Cuppers' book. If the spot you describe is not deep within an inaccessible reedy swamp, then it is probably not a nest but the latter choice of your sentence. They do perch on the ground much more than most hawks.
