For those who are interested in news regarding the proposed heliport
and joy-flights at Capertee (NSW), I forward an email from the
Secretary of the Capertee Valley Environment Group. I'll keep you up
to date with further developments.

Dear All,
Re: DA 319/06 Heliport Capertee
Proponent, Mr Mark Lilley, has deemed the DA for his heliport as
"Refused Development Consent by Lithgow City Council." Mr Lilley
claims that the DA has been with Council in excess of 42 days and
therefore he can take his Right of Appeal to the Land and Environment
Court (L&EC.) I confirmed this with the L&EC Office this morning.
The matter is listed for hearing at the L&EC on the 15th June 2007.
My understanding is that all Submissions re DA 319/06 received by
Council will be forwarded to the L&EC. If Council so chooses, it may
call upon expert witnesses to support its case.
I'm told this is a much better situation than Council approving the
DA and us taking our Right of Appeal to the L&EC.
I shall be talking with the Environmental Defender's Office later and
if there is anything which we need to do I shall let you know.
