A first response which implies the Japanese - and Australian - governments have responsibilities here: Little Terns are covered by the 1974 JAMBA treaty. In Article VI Australia and Japan undertake that: "Each Government shall endeavour to take appropriate measures to preserve and enhance the environment of birds protected under the provisions of this Agreement. In particular, it shall: (a) seek means to prevent damage to such birds and their environment" See: http://www.austlii.edu.au/cgi-bin/disp.pl/au/other/dfat/treaties/1981/6.html?query=%22bird%22+and+%22japan%22 I wonder if a road alignment AND ASSOCIATED WORKS (perhaps incorporating a bird hide) could be designed to give better protection to the site.
