This is still the case.  Technologic Systems has become a member of
the SD card association so we were able to create our own hardware
core and software driver though our hands are tied such that we cannot
release source code to either the driver or the hardware core. 
However, we have written a binary Linux driver module and a set of
generic, OS-independent read/write routines for accessing the SD flash
inside of an ARM object (.o) file.  If it weren't for the GPL, we
could also have provided a precompiled kernel with the driver
built-in, but unfortunately we have to boot to an initrd to load the
SD driver as a module.
