Hi Jenny,
This is the reply I received from Warren concerning the nature reserves in NSW. I have not yet had a chance to read it properly. It came in before your query about the Cootamundra Road section of Jindalee so hopefully it is mentioned in here.
Mark
There are a number of state forests involved in the new parks/reserves, although I’m not familiar with quite a few of the names – presumably they are further west. If you go to this link:
http://www.legislation.nsw.gov.au/maintop/view/inforce/act+112+2010+cd+0+N
you’ll find the actual legislation – the relevant bit is all the schedules (see menu on left side of screen). Below is a bit of blurb as to what each schedule represents – scan through each and you’ll see all the state forest names. I notice Wyalong State Forest is being reserved. It states that Buddigower State Forest is to be “vested in the NPW minister”, although I don’t particularly understand all the legal mumbo-jumbo, I assume this means it is now under control of DECCW/NPWS but is not yet gazetted as a reserve – might be some things to be resolved there like existing leases? Reefton State Forest appears to be transferred from State Forest and is now “subject to the crown lands act, to be used for the purposes of nature conservation”. Not sure what that’s all about. Jindalee is now a national park.
Hope that helps
Cheers
Warren
State Forest, Crown land and reservation under NPW Act
Under the Act some State Forests are revoked and reserved under the NPW Act. Other State Forests are made subject to the Crown Lands Act. In addition, some Crown land is reserved under the NPW Act. The Schedules identify the relevant State Forests and Crown lands:
· Schedule 1 lists the State Forests which are revoked and reserved as national park, nature reserve or state conservation area on 1 January 2010. The newly created parks are consolidated under broad regional names such as South West Woodland Nature Reserve.
· Schedule 2 lists State Forests which are revoked and reserved as national parks and nature reserve on 1 January 2012.
· Schedule 3 lists the State Forests which are revoked and made subject to the Crown Lands Act on 1 January 2011. These lands, are deemed to have been assessed for nature conservation or for other purposes compatible with the environmental values of the land (section 6)
- Schedule 4 lists the Crown land reserved as national park, nature reserve or state conservation area on 1 January 2011. Part 2 of Schedule 4 includes the reservation of the bed of Merro lake as offset for revocation of part of Murramarang National Park (section 11 provides for the revocation of that part of Murramarang National Park where the Merry Beach Caravan Park is located).
- Schedule 5 reserves Joulni Station as part of Mungo National Park and Mungo State Conservation Area.
- Schedule 6 lists State Forests which are revoked and vested in the NPW Minister on 1 January 2011.
- Schedule 7 lists Crown land that is reserved as a conservation zone under the Brigalow and Nandewar Community Conservation Area Act (“Brigalow Act”). This Schedule amends the Brigalow Act.
Forestry operations on land remaining as State forest
Some South-Western State Forests will continue to be harvested. An integrated forestry operations approval (IFOA) under the Forestry and National Park Estate Act (FNPE Act) is required for the remaining South-Western State Forests by 30 June 2011. The Act operates to provide for harvesting approval over South Western State Forests until the IFOA is granted or 30 June 2011.
Commencement of Act
The Act will commence on 1 January 2011.
