I found the upper photo too dark to reveal too much but the lower one clearly shows an orange collar and a tail protruding well beyond the wing tips ruling out, I believe, Australian Hobby and Brown Falcon.  The long rounded tail and orange collar suggests Brown Goshawk.  The squat appearance may be the result of the bird fluffing out its feathers to keep warm.  Not 100% sure but more likely than the first two suggestions.
